I am a member of a company which, for at least the last 6 months prior to my application for a residence permit, under the business plan, is engaged in full-time employment in the Republic of Lithuania with full-time Citizens of the Republic of Lithuania, other EU Member States or EFTA Member States or foreigners permanently residing in the Republic of Lithuania whose monthly wages and salaries in total amount to at least 2 of the average monthly gross wages and salaries of employees of the national economy (including individual enterprise wages and salaries) of the last quarter published by Statistics Lithuania, and an equity value of which (in the case of non-AB and non-UAB assets) is at least EUR 28,000, of which at least EUR 14,000 is my invested funds or other assets and I am the manager of this company or the shareholder of AB or UAB, the nominal value of the shares owned by whom is not less than 1/3 of the authorized capital of the company.

What are the requirements for a company and me to receive a temporary residence permit?

Requirements for a company:

  • a business plan following which the activity has been in operation for at least 6 months;
  • citizens of Lithuania, other EU or EFTA Member States or foreigners permanently residing in the Republic of Lithuania work full time, whose monthly wages and salaries in total amount to at least 2 of the average monthly gross wages and salaries of employees of the national economy (including individual enterprise wages and salaries) of the last quarter published by Statistics Lithuania;
  • equity value is at least EUR 28,000;
  • the activity has been carried out for at least 6 months according to the business plan in the Republic of Lithuania.

Requirements for me:

  • you have to be a company manager or a shareholder of UAB or AB with at least 1/3 of the company’s authorized capital);
  • in the case of AB or UAB, you have to own shares of the company with a nominal value of at least EUR 14 thousand, and in the case of an IĮ, MB or TŪB, to have a contribution (cash or other assets) to the company or association of at least 14 thousand euros.

How can I receive or replace my temporary residence permit?

1. the application number;

Documents justifying the issue / replacement of a temporary residence permit:

4. documents certifying the activity of the company in the Republic of Lithuania for at least the last 6 months according to the business plan:

  • documentation of the location of the company headquarters (e.g. the premises lease agreement);
  • no more than 10 contracts that certify the business activities of the company;
  • if the business requires the appropriate permits or licenses, then these permits;
  • documents justifying the company’s transactions and events (e.g. bank statement of the account of this company, invoices, cashier’s and expense warrants);
  • company records of transactions and events (e.g. ledger, transaction log).

5. the company‘s employees‘ employment contracts;

These are citizens of Lithuania, other EU or EFTA Member States or foreigners permanently residing in the Republic of Lithuania who work full time, whose monthly wages and salaries in total amount to at least 2 of the average monthly gross wages and salaries of employees of the national economy (including individual enterprise wages and salaries) of the last quarter published by Statistics Lithuania.

6. Documents submitted to the State Enterprise Centre of Registers;

  • documents of incorporation or acquisition of the company and articles of association (regulations);
  • documents showing that the value of the company’s equity (in the case of non-AB or UAB – assets) is at least EUR 28 thousand (company financial statements (balance sheet, statement of changes in equity)), of which at least EUR 14 thousand is your invested funds or other assets (in the case of AB or UAB these are shares of the company owned by you that have a nominal value of at least EUR 14 thousand and in the case of an IĮ, MB or TŪB it is a contribution (cash or other assets) to a company or association the amount of which is no less than EUR 14 thousand) if one financial year has elapsed since the date of incorporation of the company;
  • documents that you are the manager of the company or the shareholder of AB or UAB, the nominal value of the shares owned by whom is not less than 1/3 of the authorized capital of the company (list of shareholders of AB or UAB).

7. if one financial year since the date of incorporation of the company has not elapsed: company balance sheet or statement of changes in equity, in which the value of the equity (in the case of non-AB or UAB – assets) is at least EUR 28 thousand;

8. the document regarding the sufficient means of subsistence;

The amount of the means of subsistence is 1 minimum monthly salary per month. The means must be sufficient for the duration of the temporary residence permit applied for or for at least one year.

9. the document regarding the place of residence;

The document certifying that you have a dwelling where you intend to declare your place of residence and that the living space for each adult who declares his place of residence is at least 7 square meters:

10. the criminal record certificate;

It is only needed when applying for your first temporary residence permit. These are certificates issued by the competent authorities of the foreign countries where you have lived or currently live in the last 2 years prior to your arrival in Lithuania (unless your stay abroad has been shorter than 6 months within a 12 month period certifying that you were not (were) convicted in these states, which must be issued not less than 6 months before the date of application for the temporary residence permit, translated into Lithuanian, and legalized and / or certified by an Apostille, when it is necessary. If you have been convicted, the certificate must state when and for what offense you have been convicted, what your sentence has been and whether it has been committed.

A certificate stating that you have not been convicted may be provided in the original English language or there may be provided an English translation of the document in another language, certified by the translator.

11. the document regarding the health insurance (a sum of the insurance – EUR 6 000);

The health insurance must meet such requirements:

  • the insurance must cover the cost of emergency medical care as defined by the Law on the Health System of the Republic of Lithuania and payment of the costs that you may incur as a result of your return to a foreign country for medical reasons (transportation, including escort of personal health care professional (s)); and
  • the insurance must be valid for the duration of the temporary residence permit applied for or for at least one year.

You do not need health insurance if you are / will be paying flat-rate social security contributions or they will be paid instead of you.

12. the document proving the legal being

For example, a visa or a residence permit.

You must pay a state fee for accepting, examining, deciding and issuing a temporary residence permit application / replacement:

  • following the general order – EUR 120;
  • following the urgent procedure – EUR 240;

You must apply for a document to be issued:

  • to the central office of the Migration Department.

Temporary residence permits are decided upon and temporary residence permits are issued during:

  • regarding the issue of a permit:
    • following the general order – within 4 months;
    • following the urgent procedure – within 2 months;
  • regarding the changing of the permit:
    • following the general order – within 2 months;
    • following the urgent procedure – within 1 month.

Nota bene:

upon application for a temporary residence permit you may be issued with a multiple entry national visa for a period not exceeding 5 months from the date of application for the temporary residence permit in Lithuania;

if you have been issued with a 1 year national visa or multiple national visas with a total validity of 1 year and you intend to apply for a temporary residence permit you should apply for it in advance – 2-4 months before the expiry date of the existing national visa.

For how long will I get my temporary residence permit?

Your temporary residence permit will be issued or replaced to you for 2 years.

May I bring family members?

You may bring your family members and they may apply for a temporary residence permit together with you right away. Family members include: a spouse, a registered partner, unmarried minor children dependent on you, your dependent parents if they are dependent on you for at least one year and cannot benefit from the support of other family members living abroad.

When do I have to apply for a replacement of my temporary residence permit?

Following the general order, the application for the replacement of the temporary residence permit and the documents accompanying it shall be submitted at least 2 months and the request for the replacement of the temporary residence permit and the documents accompanying it shall be submitted at least 1 month before the expiry of the temporary residence permit, but no earlier than 4 months before.

  • you must confirm that the purpose of your arrival is to work for the company.

 How can I receive or replace my temporary residence permit?

  • documents that you are the manager of the company.

7. if one financial year since the date of incorporation of the company has not elapsed: company balance sheet or statement of changes in equity, in which the value of the equity (in the case of non-AB or UAB – assets) is at least EUR 28 thousand;

8. your employment contract;

9. the document regarding the sufficient means of subsistence;

The amount of the means of subsistence is 1 minimum monthly salary per month. The means must be sufficient for the duration of the temporary residence permit applied for or for at least one year.

What are the requirements for a company and me to receive a temporary residence permit?

Requirements for a company:

  • at least five workplaces have been established and they are full-time employed by citizens of the Republic of Lithuania, other EU Member States or EFTA Member States or foreigners permanently residing in the Republic of Lithuania;

Requirements for me:

  • you have to be a company manager or a shareholder of UAB or AB with at least 1/3 of the company’s authorized capital);
  • in the case of AB or UAB, you have to own shares of the company with a nominal value of at least EUR 260 thousand, and in the case of an IĮ, MB or TŪB, to have a contribution (cash or other assets) to the company or association of at least 260 thousand euros.

How can I receive or replace my temporary residence permit?

Study

You can come to Lithuania for study or science. If You are a student, lecturer or researcher and intend to stay in Lithuania for a maximum of one year, You may obtain a multiple entry national visa. If You intend to stay longer, You should opt for a temporary residence permit (usually issued for one year, for researchers and lecturers for 2 years, subject to replacement at a later date). You may obtain a national visa for the duration of the application for a temporary residence permit.

If You have a valid residence permit or a national visa for study purposes issued by another European Union Member State and you are covered by a program funded by the European Union or its Member States promoting the mobility of third country nationals within the European Union or by agreement between two or more higher education institutions, You may come for part of your studies and stay in the Republic of Lithuania without a visa for up to 360 days.

If You have a valid temporary residence permit or a national visa issued by another European Union Member State for the purpose of carrying out research and development activities, You may enter and stay in the Republic of Lithuania without a visa for up to 180 days within a 360 day period, to carry out some of your research and experimental development work at a science and study institution. Members of Your family who hold a valid temporary residence permit or national visa issued by another European Union Member State have the right to enter and stay in the Republic of Lithuania for the same period as You.

3. the number of the letter of mediation of the research and higher education institution;

The letter of mediation must confirm:

  • that you have been admitted to this institution for the study program (s) or doctoral studies;
  • that the fees imposed by that institution have been paid;
  • that you have sufficient funds to cover study and return travel expenses.

When you arrive under a European Union or multilateral program that involves mobility measures, or an agreement between two or more research and higher education institutions, the letter of mediation indicates the specific European Union or multilateral program that covers mobility measures, or the name of an agreement between two or more research and higher education institutions.

4. the consent of your parents or one of them, your guardian or other legal representative regarding your intended life (studies) in the Republic of Lithuania, if you are a minor;

5. the document regarding the sufficient means of subsistence;

The amount of the means of subsistence is 0.5 of the minimum monthly salary per month. The means must be sufficient for the duration of the temporary residence permit applied for or for at least one year.

6. the document stating that you have sufficient funds to cover your studies and return travel expenses;

For example, a bank statement if your institution does not confirm in your letter of mediation that you have sufficient funds to pay for study and return travel expenses.

7. the document regarding the place of residence;

The document certifying that you have a dwelling where you intend to declare your place of residence and that the living space for each adult who declares his place of residence is at least 4 square meters, under the property right or you use such premises on a lease or use basis, if the relevant contract is for a period of at least the duration of the temporary residence permit and is registered with the State Enterprise Centre of Registers (Real Estate Register), or signed and stamped by a notary of the Republic of Lithuania, an elder of the eldership of the municipality of the Republic of Lithuania, or a civil servant authorized by the Migration Department or Migration Department, if this legal entity is required to have a stamp, the legal entity’s commitment to provide you with a suitable accommodation where you will declare your residence and meet the requirements for the residence during the period of validity of the temporary residence permit.

    • following the urgent procedure – within 1 month.

Nota bene:

  • upon application for a temporary residence permit you may be issued with a multiple entry national visa for a period not exceeding 5 months from the date of application for the temporary residence permit in Lithuania;
  • if you have been issued with a 1 year national visa or multiple national visas with a total validity of 1 year and you intend to apply for a temporary residence permit you should apply for it in advance – 2-4 months before the expiry date of the existing national visa.

I want to come under a student exchange program. What do I need to do?

If You have a valid residence permit or a national visa for study purposes issued by another European Union Member State and you are covered by a program funded by the European Union or its Member States promoting the mobility of third country nationals within the European Union or by agreement between two or more higher education institutions, You may come for part of your studies and stay in the Republic of Lithuania without a visa for up to 360 days.

May I stay in Lithuania after graduation?

After graduation, you have the opportunity to apply for a temporary residence permit for a period of 12 months for the purpose of seeking employment and self-employment.

May I bring family members?

The health insurance must meet such requirements:

  • the insurance must cover the cost of emergency medical care as defined by the Law on the Health System of the Republic of Lithuania and payment of the costs that you may incur as a result of your return to a foreign country for medical reasons (transportation, including escort of personal health care professional (s)); and
  • the insurance must be valid for the duration of the temporary residence permit applied for or for at least one year.

You do not need health insurance if you are / will be paying flat-rate social security contributions or they will be paid instead of you.

Temporary residence permits are decided upon and temporary residence permits are issued during:

  • Regarding the issue of a permit:
    • following the general order – within 3 months;
    • following the urgent procedure – within 45 days;
  • Regarding the replacement of the permit:
    • following the general order – within 2 months;
    • following the urgent procedure – within 1 month

You must apply for the submission of documents:

  • to the Embassy of Lithuania outside the territory of EU Member States;
  • to the Territorial branch of the Migration Department if you are in Lithuania.

You must pay state fees:

  • for accepting, examining, deciding and issuing a temporary residence permit application / replacement:

Nota bene:

  • upon application for a temporary residence permit you may be issued with a multiple entry national visa for a period not exceeding 5 months from the date of application for the temporary residence permit in Lithuania;
  • if you have been issued with a 1 year national visa or multiple national visas with a total validity of 1 year and you intend to apply for a temporary residence permit you should apply for it in advance – 2-4 months before the expiry date of the existing national visa.

May I bring family members?

You may. Family members include: a spouse, a registered partner, unmarried minor children dependent on you, your dependent parents if they are dependent on you for at least one year and cannot benefit from the support of other family members living abroad.

They can apply for temporary residence permits at the same time as you. They will be issued with temporary residence permits for the same period as your temporary residence permit.

When do I have to apply for a replacement of my temporary residence permit?

Following the general order, the application for the replacement of the temporary residence permit and the documents accompanying it shall be submitted at least 2 months and the request for the replacement of the temporary residence permit and the documents accompanying it shall be submitted at least 1 month before the expiry of the temporary residence permit, but no earlier than 4 months before.

Do I need a work permit in the Republic of Lithuania?

You are exempt from the obligation to obtain a work permit in the Republic of Lithuania.

How long will my temporary residence permit last?

Your temporary residence permit will be valid for the entire duration of your appointment to the host undertaking, but for no longer than 1 year.

How much time can be spent in the European Union?

In total, you cannot spend more than 1 year as an intra-corporate transferee in the European Union. After the transfer period, you must return to the sending undertaking established outside the EU.

Can I be an intra-corporate transferee multiple times?

If you have already received a temporary residence permit as an intra-corporate transferee and have since left, you may apply for a new temporary residence permit as an intra-corporate transferee within 3 months of the transfer.

For how long will I get my temporary residence permit?

Your temporary residence permit will be issued to you or replaced for the duration of the transfer to a host undertaking established in the Republic of Lithuania for a maximum period of 3 years.

 Family Reunification

This section is for those who are nationals of third countries (countries which are not members of the European Union or the European Free Trade Association) or family members of citizens of the Republic of Lithuania, who after 2004 did not reside in any Member State of the European Union.

If your family member lives in Lithuania, in the cases described below, You may come to him/her and obtain a temporary residence permit. The permit is usually issued for a period of 1 year and may be subsequently replaced for a period of 2 years. For the duration of the examination of an application for a temporary residence permit You can receive a national visa.

You can stay in Lithuania as long as your family member, to whom You came, is in Lithuania, unless You receive the residence permit on other grounds.

  • signed and stamped by a notary of the Republic of Lithuania, an elder of the eldership of the municipality of the Republic of Lithuania, or a civil servant authorized by the Migration Department or Migration Department, if this legal entity is required to have a stamp, the legal entity’s commitment to provide you with a suitable accommodation where you will declare your residence and meet the requirements for the residence during the period of validity of the temporary residence permit; or

The documents, confirming the reasonable prospects of o one of the parents, to whom you come, or the spouse of the parent who has custody of you to acquire the right of permanent residence in the Republic of Lithuania, are:

  • documents proving that the foreigner, who has received a temporary residence permit, has the right to reside in the Republic of Lithuania without interruption for 5 years (for example, family, marriage or registered partnership with a Lithuanian citizen residing in the Republic or a document certifying that the alien is a member of a traditional Lithuanian religious community (faith) or a state-recognized religious association or a clergyman of another religious community or association having legal personality in the Republic of Lithuania).

6. if you come to a custodial spouse on one of your parents, a document confirming the marriage;

7. if you come to a parent with a temporary residence permit issued as a long-term resident in another EU Member State, a document stating that you have already been a member of his / her family in the country where he / she acquired the long-term residence status (in the case of replacement of a temporary residence permit, not required);

8. if you come to a parent who, through direct participation in projects of public interest, has invested in the Republic of Lithuania property that he owns, borrows or manages and uses in trust, documents supporting the investment;

The amount of the means of subsistence is 0.5 of the minimum monthly salary per month. The means must be sufficient for the duration of the temporary residence permit applied for or for at least one year.

4. if you are submitting documents together with your spouse or partner, who intends to work as a teacher or researcher, a valid residence permit or national visa issued by another EU Member State for the purpose of carrying out research and development work and a temporary permit issued to you by another EU Member State residence or national visa for the purpose of family reunification (temporary residence permit not required);

5. if your spouse or the person with whom the registered partnership is contracted has resided in the Republic of Lithuania for the last 2 years, holds a valid temporary residence permit of at least one year and has reasonable prospects of acquiring the right of permanent residence in the Republic of Lithuania, documents confirming the reasonable prospects of his/her to acquire the right of permanent residence in the Republic of Lithuania;

The document certifying that you have a dwelling where you intend to declare your place of residence and that the living space for each adult who declares his place of residence is at least 7 square meters:

  • the natural person’s commitment confirmed by a notary of the Republic of Lithuania, an elder of the eldership of the municipality of the Republic of Lithuania, or a civil servant authorized by the Migration Department to provide you with a suitable accommodation where you will declare your residence and which will meet the requirements for the residence during the period of validity of the temporary residence permit; or
  • signed and stamped by the head of the legal entity, if this legal entity is required to have a stamp, the commitment of the legal entity to provide you with a suitable accommodation where you declare your residence and which will meet the requirements of the residence for the duration of the temporary residence permit;

You do not need to provide proof of proper residence if you own the dwelling or have entered into a lease or usufruct agreement with a natural or legal person for a period of validity of the temporary residence permit registered with the State Enterprise Centre of Registers (Real Estate Register).

6. if you are coming to a spouse or person with whom you have a concluded registered partnership agreement, holding a temporary residence permit issued as a person having a long-term resident status in another EU Member State, a document stating that the marriage or registered partnership has already been entered into in the country where he / she has acquired long-term resident status (in the case of replacement of the temporary residence permit not required);

7. if you are coming to a spouse or person with whom you have a concluded registered partnership agreement, who through direct participation in projects of public interest, has invested in the Republic of Lithuania property that he owns, borrows or manages and uses in trust, documents supporting the investment;

8. the document regarding the sufficient means of subsistence (you do not need not provide in the case of the issuance of the temporary residence permit, if you are a family member of a foreigner granted asylum in the Republic of Lithuania and applied for a temporary residence permit within 3 months of granting asylum in the Republic of Lithuania);

The amount of the means of subsistence is 1 minimum monthly salary per month. The means must be sufficient for the duration of the temporary residence permit applied for or for at least one year.

9. the document regarding the place of residence (you do not need not provide in the case of the issuance of the temporary residence permit, if you are a family member of a foreigner granted asylum in the Republic of Lithuania and applied for a temporary residence permit within 3 months of granting asylum in the Republic of Lithuania);

10. the criminal records certificate;

It is only needed when applying for your first temporary residence permit and only if you are over 14 years old. These are certificates issued by the competent authorities of the foreign countries where you have lived or currently live in the last 2 years prior to your arrival in Lithuania (unless your stay abroad has been shorter than 6 months within a 12 month period certifying that you were not (were) convicted in these states, which must be issued not less than 6 months before the date of application for the temporary residence permit, translated into Lithuanian, and legalized and / or certified by an Apostille, when it is necessary. If you have been convicted, the certificate must state when and for what offense you have been convicted, what your sentence has been and whether it has been committed. The certificate stating that you have not been convicted may be provided in the original English language or there may be provided an English translation of the document in another language, certified by the translator’s signature.

11. if your spouse or person with whom you have a concluded registered partnership agreement has applied for a temporary residence permit as a highly qualified worker or as a citizen of Australia, Japan, USA, Canada, New Zealand or South Korea, a written declaration that I am not convicted

It is only needed when applying for your first temporary residence permit if you have not been convicted in the foreign country (s) where you lived or have lived for the last 2 years prior to your arrival in the Republic of Lithuania.

Or the criminal record certificate;

It is only needed when applying for your first temporary residence permit. These are certificates issued by the competent authorities of the foreign countries where you have lived or currently live in the last 2 years prior to your arrival in Lithuania (unless your stay abroad has been shorter than 6 months within a 12 month period certifying that you were not (were) convicted in these states, which must be issued not less than 6 months before the date of application for the temporary residence permit, translated into Lithuanian, and legalized and / or certified by an Apostille, when it is necessary. 12. the document regarding the health insurance (a sum of the insurance -EUR 6 000) (you do not need to provide in the case of the issuance of the temporary residence permit, if you are a family member of a foreigner granted asylum in the Republic of Lithuania and applied for a temporary residence permit within 3 months of granting asylum in the Republic of Lithuania);

The health insurance must meet such requirements:

  • the insurance must cover the cost of emergency medical care as defined by the Law on the Health System of the Republic of Lithuania and payment of the costs that you may incur as a result of your return to a foreign country for medical reasons (transportation, including escort of personal health care professional (s)); and
  • the insurance must be valid for the duration of the temporary residence permit applied for or for at least one year.

You do not need health insurance if you are / will be paying flat-rate social security contributions or they will be paid instead of you.

13. the proof of legal being if you are submitting an application when being in Lithuania;

For example, a visa or a residence permit.

You must pay a state fee for accepting, examining, deciding and issuing a temporary residence permit application / replacement:

  • following the general order – EUR 120;
  • following the urgent procedure – EUR 240;

You must apply for a document to be issued:

  • to the Territorial branch of the Migration Department.

Temporary residence permits are decided upon and temporary residence permits are issued during:

  • Regarding the issue of a permit:
    • following the general order – within 4, 3, 2 or 1 month;
    • following the urgent procedure – within 2 months, 45 Days, 1 month or 15 Days;
  • Regarding the replacement of the permit:
    • following the general order – within 2 months;
    • following the urgent procedure – within 1 month

Nota bene:

  • upon application for a temporary residence permit you may be issued with a multiple entry national visa for a period not exceeding 5 months from the date of application for the temporary residence permit in Lithuania;
  • if you have been issued with a 1 year national visa or multiple national visas with a total validity of 1 year and you intend to apply for a temporary residence permit you should apply for it in advance – 2-4 months before the expiry date of the existing national visa.

When do I have to apply for a replacement of my temporary residence permit?

Following the general order, the application for the replacement of the temporary residence permit and the documents accompanying it shall be submitted at least 2 months and the request for the replacement of the temporary residence permit and the documents accompanying it shall be submitted at least 1 month before the expiry of the temporary residence permit, but no earlier than 4 months before.

For how long will I get my temporary residence permit?

Your temporary residence permit will be issued or replaced for the same period as the temporary residence permit is issued or replaced to your spouse or to the person with whom your registered partnership agreement is signed.
